Be honest about what you sell and what you own, use only material you are authorised to use, pay and communicate through the proper workflow, handle other people’s property carefully, and raise problems promptly. Nothing in these terms excludes rights that cannot lawfully be excluded, including rights under the Australian Consumer Law.
1. Scope and acceptance
These Terms & Conditions (“Terms”) apply to the Second Quest Miniatures website and services, operated by Aspyre Pty Ltd (ACN 689 591 740, ABN 93 689 591 740) trading as Second Quest Miniatures (“Second Quest”, “we”, “us” or “the Platform”). They apply when you browse, create an account, list or buy a miniature, post or accept a maker commission, generate character artwork, order digital files, or request printing, painting or fulfilment.
By using the Platform or submitting a listing, brief, bid, generation request or order, you agree to these Terms. If you act for a business or another person, you confirm that you have authority to bind them. Transaction-specific details shown in a listing, accepted bid, quote or checkout form part of the agreement for that transaction. If they conflict with these Terms, the more specific written transaction term applies, except that mandatory law always prevails.
2. Accounts and eligibility
- You must be at least 18 years old and legally able to enter contracts. A minor may use the service only through a parent or legal guardian who accepts responsibility for the account and transaction.
- Provide accurate, current information and use your own verified email address. Do not impersonate another person or create accounts to evade restrictions.
- You are responsible for activity under your account and for keeping access to your email, Google/Clerk account and devices secure. Tell us promptly if you suspect unauthorised use.
- Account features, quotas, seller verification and payouts may depend on third-party services such as Clerk and Stripe.
3. Who supplies what
Second Quest has different roles depending on the transaction:
- Second Quest products and services: where a product, custom STL pack, print or paint service is expressly sold by Second Quest, Second Quest is the supplier.
- Community marketplace sales: the named seller is the supplier of the listed miniature. The buyer pays that seller through the seller’s connected Stripe account. Second Quest provides listing, checkout, record and communication tools and receives a platform fee.
- Maker commissions: the selected painter or printer is the supplier of the accepted commission. The customer pays that maker through the maker’s connected Stripe account. Second Quest facilitates the brief, bids, payment and delivery workflow and receives a platform fee.
Whether a seller or maker is acting as a business or as a private individual can affect the legal rights applying to that transaction. Consumer guarantees generally apply to goods and services supplied in trade or commerce. Private sales still carry important rights concerning title, undisturbed possession and undisclosed securities. Second Quest may help users communicate about a problem but does not replace either party’s legal responsibilities.
4. Marketplace seller terms
By publishing a listing, you promise that:
- you own the item, are entitled to sell it, and it is not stolen, counterfeit, subject to an undisclosed debt or security interest, or otherwise unlawfully held;
- the listing title, description, price, manufacturing method, material, scale, paint status, quality and condition are accurate and not misleading;
- current-item photographs show the actual item and clearly disclose chips, cracks, repairs, missing parts, failed prints, recasts, conversions and other material defects;
- you have permission to use all listing text and images and to sell any branded, licensed or artist-created item;
- the item is safe and lawful to sell and ship, and any hazards or age restrictions are clearly stated; and
- you will promptly update or remove a listing that is no longer available.
You must complete Stripe’s seller, identity and bank verification before accepting payment, package the item appropriately, use the promised tracked shipping method, provide genuine tracking, and respond reasonably to the buyer. You are responsible for refunds, disputes, taxes, GST obligations, product safety and other obligations applying to your sale. If you sell in trade or commerce, you must identify yourself and comply with the Australian Consumer Law and any other applicable business laws.
You may not manipulate prices, create sham transactions, move a Platform-arranged transaction off-platform to avoid disclosed fees, or misuse chargebacks or refunds. Second Quest’s ownership-history record is a Platform provenance record; it is updated after the delivery workflow is completed but is not a government title register or authenticity guarantee.
5. Marketplace buyer terms
- Review the entire listing, photographs, condition disclosure, seller identity, price and shipping charge before paying.
- Provide a complete Australian delivery address and promptly correct any error before dispatch. Additional costs caused by an incorrect address may be payable by you where lawful.
- Do not confirm receipt until the parcel has arrived and you have had a reasonable opportunity to check it.
- Raise non-delivery, damage, authenticity or material-description concerns with the supplier promptly and preserve the packaging, photographs, tracking and messages. Prompt notice helps investigation but does not remove rights that cannot lawfully be limited by time.
- Use payment disputes and chargebacks honestly and only after making a reasonable attempt to resolve the issue with the responsible supplier, unless urgent action is required to protect your rights.
There is no automatic change-of-mind return right unless the relevant seller offers one. This does not affect remedies for faulty, unsafe, materially misdescribed or undelivered goods where applicable law provides them.
6. Maker commissions
Customers posting briefs
- Your brief, files, photos, budget, quantity, scale, finish, due date and shipping needs must be accurate and complete.
- You must own or be authorised to use any miniature, artwork or model file and must have any licence needed to commission printing, painting or reproduction.
- Selecting a bid and completing payment creates a contract with the selected maker on the accepted brief, bid, portfolio representations and these Terms.
- New references, changed poses, extra miniatures, revised colour schemes, repair work or other scope changes may require a new price and timeline.
Makers bidding and fulfilling work
- Your profile and portfolio must accurately represent work you created. Do not present resold, copied or AI-generated images as examples of your own physical work without clear disclosure.
- Your bid must be a genuine, complete customer-facing quote and must state your approach and realistic completion estimate. Disclose material exclusions, shipping assumptions and any work you intend to subcontract.
- Use reasonable care and skill, follow the accepted brief, communicate material problems promptly, keep customer files and addresses private, and take reasonable care of any physical miniature entrusted to you.
- Do not begin paid work until the Platform confirms payment. For paint-only jobs, confirm receipt of the customer’s miniature before marking work in progress.
- Provide genuine return tracking and do not mark a job complete before the agreed work has been performed and dispatched.
Dates are estimates unless expressly guaranteed. The maker remains responsible for the service and for any consumer-law remedy. Second Quest may facilitate communication and record payment status but does not supervise the maker’s studio or guarantee an independent maker’s workmanship.
7. AI character art builder
The character builder uses guided text, optional reference images and third-party generative-AI services to create fantasy character artwork. You acknowledge that generated results are probabilistic and may contain unexpected anatomy, equipment, text, visual artefacts or differences from your instructions. Results may not be unique and similar images may be generated for other users.
- You retain rights you already hold in your prompts, character descriptions and reference images.
- You give Second Quest a limited licence to host, copy, resize, moderate and transmit those inputs to service providers solely to operate, secure and support the generation and any requested STL workflow.
- To the extent Second Quest owns any rights in an art output, we assign those rights to you when the output is generated. This does not transfer rights in the Platform, its branding, templates, third-party material or another person’s intellectual property, and it does not guarantee that an output qualifies for copyright protection or is exclusive.
- You must not submit confidential material; intimate imagery; identifiable photographs of real people; images of children; or protected characters, logos, celebrity likenesses or another artist’s work unless you hold every permission needed for the requested processing and use.
- Free generation allowances are a revocable fair-use feature, have no cash value, and may be adjusted or paused prospectively to control safety, abuse, capacity or cost. The current allowance is displayed in the builder.
Generated character images are normally retained privately for 21 days so you can compare and revise them. An image selected for a paid STL request may be retained longer as part of that order. Authorised Second Quest administrators may review private inputs and outputs where reasonably necessary for fulfilment, moderation, support, safety, abuse prevention or legal compliance. Images are not placed in a public gallery unless you separately agree.
8. Custom AI-assisted STL service
The custom STL service provides five AI-generated interpretations based principally on the submitted front reference and instructions. Additional views help describe hidden details; they do not create additional poses. The service is not a manually sculpted exact replica, five manually revised drafts, or five different poses.
What is included
- Five individual STL geometry files delivered digitally.
- AI-assisted reference preparation, generation direction, rejection of obvious failed generations, and a basic visual and miniature-printability review.
- Reasonable strengthening of fragile areas such as ankles, wrists, weapons and narrow details where printing is the stated goal. This may alter fine detail or proportions.
What is not included unless expressly agreed
A physical miniature, painting, pre-supported files, texture or material maps, decorative bases, rigging, animation, editable project/source files, manual resculpting, guaranteed likeness, or guaranteed compatibility with every printer and slicer.
STL files contain geometry, not colour or painted surface information. You may need to scale, orient, support or repair a file. Printer type, material, supports, layer height, exposure, calibration and handling affect the result. Tell us before work begins if the file is not for printing, fragile features must not be strengthened, a precise finished size is essential, or a feature must remain unchanged.
If the complete delivered set contains no reasonably usable option because of substantial technical or generation failures against the original brief, contact us promptly with screenshots and details. We will assess the set and, where appropriate, provide a repair, replacement option, additional generation, reduced price or refund. Differences of style, resemblance or interpretation are not automatically defects, but this clause never limits remedies required by law.
STL licence
After full payment, you receive a perpetual, non-exclusive, non-transferable licence to download, retain and modify the delivered STL files and make unlimited physical prints for your own personal, non-commercial use. Unless a separate commercial licence is agreed in writing, you must not sell, share, upload, sublicense or redistribute the files or conversions; distribute modified versions; include them in a library, bundle, marketplace or subscription; sell physical prints made from them; or use them to train or develop an AI model.
The licence extends only to rights Second Quest can lawfully grant and does not authorise infringement of third-party characters, artwork, trade marks or designs. AI-assisted files may not be legally exclusive and similar geometry may be generated independently.
Private delivery pages display their own download deadline, typically 21 days. Download and back up every file before expiry. Expiry does not extinguish any statutory right or agreed remedy.
9. Second Quest printing and painting
Printing and painting are optional, separately priced stages. A print or print-and-paint request is not accepted until the final price, inclusions and shipping are shown and payment is confirmed.
- Printed miniatures may show layer lines, support marks, minor cleanup marks and reasonable dimensional variation inherent to the chosen process and scale.
- Very fine details may be strengthened, simplified or omitted for durability. Painted colours can vary from on-screen previews because of lighting, display settings, pigments and hand application.
- Unless described otherwise, custom miniatures are hobby collectibles, not toys. Small parts and brittle materials can present choking or injury hazards and should be kept away from young children.
- Quoted completion dates are estimates unless expressly guaranteed. We will communicate material delays and offer any remedy required by law.
10. Prices, fees, taxes and payments
- Prices are in Australian dollars unless stated otherwise. The final checkout shows the item or service price, shipping and total before payment.
- Marketplace sellers and makers currently pay a 13% Second Quest fee on their advertised item price or accepted bid, plus Stripe’s applicable processing fees. The displayed estimate may differ from Stripe’s final fee because of payment method, card origin, refunds or disputes.
- Community buyers currently pay the advertised price plus disclosed shipping, with no separate buyer service fee. Second Quest may change fees prospectively, but the fees shown when a listing, bid or checkout is accepted govern that transaction.
- Stripe processes payments, seller verification, connected-account payouts, refunds and disputes. Second Quest does not receive or store full card numbers.
- Each supplier is responsible for its own taxes, GST registration, records and reporting. Prices include GST only where the relevant supplier is required to charge it and the transaction says so.
11. Delivery, tracking and physical hand-off
Physical delivery is currently limited to the destinations allowed at checkout. The supplier must use appropriate packaging and the agreed tracked method. Buyers and commission customers must provide an accurate address and monitor tracking. Do not send a physical miniature to a maker until the Platform shows that payment is confirmed and private hand-off instructions are available.
Responsibility for loss or damage cannot be excluded where the law places it on the supplier. Otherwise, each party must cooperate with reasonable carrier enquiries and insurance claims. A Platform receipt confirmation updates workflow and provenance records; it does not waive a latent-defect claim or other right that cannot lawfully be waived.
12. Cancellations, returns, refunds and other remedies
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms limits any non-excludable right or remedy.
- Change of mind: there is no automatic change-of-mind refund unless the relevant supplier offers one.
- Personalised digital work: cancellation is normally available before generation or other substantive work begins. After work begins, any cancellation and refund will account for work already performed and non-recoverable costs only to the extent reasonable and lawful.
- Marketplace goods: the seller handles return and refund requests. Business sellers must provide applicable consumer-law remedies. Private-seller rights differ, but title and misrepresentation obligations remain relevant.
- Maker commissions: the selected maker handles the remedy. Scope changes, customer delay or customer-supplied defective files may affect price and timing, but do not excuse poor workmanship or other failures for which the maker is responsible.
- Second Quest goods and services: contact Second Quest. Depending on the issue and applicable law, a remedy may include repair, replacement, re-performance, cancellation, price reduction, refund or compensation for reasonably foreseeable loss.
A supplier may reasonably inspect the item, files, photographs and original brief before deciding the appropriate remedy. No notice period stated in a listing or workflow removes a statutory right.
13. Intellectual property and user content
Second Quest owns or licenses the Platform software, layout, written content, branding, catalogue material and other site assets. You may use the site only for its intended purpose and must not copy, scrape, reverse engineer, republish or commercially exploit those materials except as permitted by law.
You keep ownership of content you submit. You grant Second Quest a worldwide, non-exclusive, royalty-free licence to host, reproduce, resize, transmit and display it only as needed to operate and promote the relevant listing, profile, brief, order or service. Public listing, portfolio and profile content may be displayed publicly; private references, model files, addresses and generated assets are used only for the private workflow and purposes described in the privacy section.
You warrant that your content and requested use do not infringe copyright, trade mark, design, privacy, publicity, confidentiality or other rights. Owning a physical miniature or a copy of an artwork does not necessarily grant reproduction rights. We may remove disputed content or pause fulfilment while rights are investigated. Send infringement notices with the work, location, ownership basis and requested action to the contact address below.
14. Prohibited content and conduct
You must not use Second Quest to create, upload, list, request, sell or communicate:
- illegal, stolen, counterfeit, fraudulent, deceptive or rights-infringing material;
- child sexual exploitation material, sexualised depictions of minors, non-consensual intimate imagery, or sexual deepfakes;
- content that seriously harasses, threatens, abuses or exploits a person, or promotes terrorism or unlawful extreme violence;
- identifiable real-person likenesses for generative processing without valid consent and every necessary right;
- malware, credential theft, scraping, denial-of-service activity or attempts to bypass security, quotas, access controls or payment systems;
- false reviews, fake bids, sham sales, undisclosed conflicts, fee avoidance, spam or unsolicited commercial messages; or
- personal information, confidential files or delivery addresses except through the private fields designed for that purpose.
Fantasy combat, weapons and horror themes are permitted where lawful and not targeted abuse, but we may decline material that our providers cannot safely or lawfully process.
15. Privacy notice
Aspyre Pty Ltd, trading as Second Quest Miniatures, is responsible for the personal information it collects through the Platform. This section explains our current handling practices.
Information we collect
We may collect your name, verified email, profile and location; listings, portfolios, messages and commission details; payment, refund and payout status (but not full card numbers); shipping and private hand-off details; uploaded artwork, prompts, generated images, model files and order notes; support and complaint records; and technical information such as timestamps, device/browser data, security logs and cookies.
Why we collect and use it
We use information to authenticate accounts; operate listings, payments, payouts, orders and delivery; generate art and 3D models; support users; prevent fraud and abuse; moderate content; keep tax, accounting and audit records; improve reliability; send transactional communications; and comply with law. Marketing is sent only where permitted and can be opted out of.
Who receives it
We disclose only what is reasonably needed to the other party to a transaction and to providers supporting the service, including Clerk for authentication, Stripe for payments and seller verification, Vercel and database/blob providers for hosting and storage, OpenAI for character-image generation, Meshy or comparable 3D-processing providers for custom modelling, and email providers for transactional messages. Professional advisers, insurers, regulators, law enforcement or courts may receive information where reasonably necessary or legally required.
Some providers may process information in the United States and other countries where they or their subprocessors operate. Overseas privacy protections may differ from Australian law. Do not upload confidential or sensitive material that is unnecessary for the service.
Retention, access and complaints
Character-builder images are normally retained for 21 days; selected STL source images may be retained with the order. Private STL delivery assets are normally deleted after the deadline displayed on the delivery page, typically 21 days. Transaction, tax, fraud, audit, complaint and legal records may be retained longer where reasonably required. Backups may take additional time to cycle out.
We use reasonable technical and organisational safeguards, but no online system is risk-free. To request access to or correction of your personal information, close an account, or make a privacy complaint, email daniel@nexusaspyre.com. Explain the issue and provide enough information to identify the relevant account or transaction. We will respond within a reasonable time and may need to verify your identity. You may also contact the Office of the Australian Information Commissioner where applicable.
16. Moderation, suspension and removal
We may refuse a generation or order, hide or remove content, pause a transaction, limit features, suspend an account or preserve evidence where we reasonably believe it is necessary for safety, fraud prevention, rights protection, provider rules, legal compliance or a material breach of these Terms. Where practical and lawful, we will explain the reason and provide a reasonable opportunity to respond.
We will not withhold completed paid work or seller proceeds arbitrarily. Payment holds, refunds, reserves and payouts may also be imposed by Stripe or law. Provisions concerning payment, licences, privacy, disputes and accrued rights survive account closure.
17. Service availability and third parties
Clerk, Stripe, Vercel, OpenAI, Meshy, carriers and other third parties support the Platform. Their outages, policies and processing limits can affect availability. We may maintain, change, pause or discontinue features, generation quotas or providers. We will not materially change an already paid order without offering a reasonable alternative or remedy where required.
We do not guarantee uninterrupted access, permanent hosting of user files, or that every browser, printer, slicer or device will work with every feature. Keep your own copies of important listings, briefs, receipts, artwork and delivered files.
18. Responsibility and liability
Nothing in these Terms excludes, restricts or modifies a consumer guarantee, liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any other right or liability that cannot lawfully be excluded.
Subject to that rule, Second Quest is not responsible for the independent acts, omissions, descriptions, workmanship, tax affairs or legal compliance of a community seller, maker, buyer or customer. Users remain responsible for checking rights, specifications, compatibility, safety and suitability relevant to their transaction.
To the extent permitted by law, neither party is liable to the other for indirect or consequential loss that was not reasonably foreseeable when the agreement was made. Any responsibility is reduced to the extent the other party’s act, omission, misuse, inaccurate instructions, unsafe packaging or failure to mitigate caused the loss.
19. Changes to these Terms
We may update these Terms for new features, providers, fees, risks or legal requirements. Material changes apply prospectively and will be posted with a new effective date; where reasonably practicable, account holders will receive additional notice. The terms accepted for an existing paid transaction continue to govern that transaction unless a change is required by law or both parties agree otherwise.
20. Disputes and governing law
- Contact the responsible seller, maker or Second Quest with the order/listing reference, a clear description and supporting evidence.
- Allow a reasonable opportunity to inspect and propose a remedy. Second Quest may facilitate communication without becoming the supplier.
- If unresolved, you may use Stripe’s applicable dispute process and contact your state or territory consumer-protection body. Information about consumer guarantees is available from the ACCC.
These Terms are governed by the laws of Australia and New South Wales, without restricting any right you have to bring a claim in another court or tribunal under mandatory consumer law. The parties should attempt good-faith resolution before proceedings, but urgent relief and statutory complaint rights remain available.

If any provision is invalid or unenforceable, it is read down or severed to the minimum extent necessary without affecting the remainder. A delay in enforcing a provision is not a waiver. You may not transfer your account or a personal STL licence without written permission; Second Quest may transfer operation of the Platform as part of a genuine business restructure or sale, subject to applicable law and continued protection of accrued rights.
Ask first—especially if you need a commercial STL licence, want to use third-party artwork, or have unusual shipping, scale or printability requirements.
